Terms of use
These General Terms and Conditions of the Website (hereinafter referred to as “the GTC”) regulate the rights and obligations of the operator of the www.collectionhospitality.com website (hereinafter referred to as “the Website”) and persons when visiting the Website and using the services of the Website operator (hereinafter referred to as “the User”). An integral part of these GTC are also the Cookies Policy and the Privacy Policy.
The Operator and owner of the Website is Collection Hospitality s.r.o., Company Reg. No.: 19087349, with its registered office at Radlická 751/113e, Jinonice, 158 00 Prague 5, contact e-mail address: office@collectionhospitality.cz (hereinafter referred to as “the Operator”).
By visiting, browsing and using the Website (including clicking on links), the User expresses their consent to the these GTC. If the User does not agree to these GTC, the User is not authorised to use the Website. The Operator does not agree to any changes in the present GTC proposed by the Users and/or to the Users’ own terms and conditions.
Use of the Website
Access to and use of the Website are free of charge. The User bears the cost of the connection and equipment associated with their access to the Internet and the websites. The User is responsible for their own use of the Website.
The User is not authorised to interfere in any way with the functioning of the Website, the technical settings of the Website, the content of the Website, or to interfere in any way with its security. Furthermore, the User is not authorised to abuse or use the content of the Website for any purpose other than the one for which the Website is operated. The User undertakes to refrain from using the Website in contravention of generally binding legislation, public order and good morals, as well as these GTC. Otherwise, the User shall be liable for any damage incurred by the Operator and/or third parties as a consequence of this unauthorised conduct.
The Website contains a dedicated field for entering the User’s e-mail address in the case of their interest in receiving the Operator’s newsletter, as well as a contact form which the User can use to contact the Operator as well as to subscribe to the Operator's newsletter. The processing of personal data obtained through the use of these services by the User is governed by the Privacy Policy.
Limitation of liability of the Operator
The Operator warns the User that the Operator does not guarantee the uninterrupted availability of the Website and that the Website may be temporarily unavailable, for example due to maintenance or technical faults. The Operator reserves the right to cancel the Website or to completely restrict the availability of the Website. In this case, Users shall not be entitled to any compensation or refund.
The Operator is not responsible for:
- the functionality of the User’s Internet connection or their equipment, nor for the functionality of the public Internet network;
- any possible damage which the User may incur due to changes in the Website or these GTC;
- completeness and accuracy of the information provided for on the Website;
- for any malware or other harmful programs.
The Website contains various third-party integrations (e.g. maps, widgets, etc.) that display content operated or owned by third parties distinct from the Operator. The operator or the owner of these integrations is responsible for their content and their use is governed by the terms of these third parties, i.e. their operators or owners. The Operator is not responsible for the use and content of those third-party integrations (its correctness, timeliness and availability) and shall not be liable towards the User for any harm which the User may incur in connection with using those integrations. The Website also contains the links which, when clicked on by Users, redirect them to other external third-party sites distinct from the Operator. The use of these external sites is governed by the terms and conditions of the third parties operating those other sites. The Operator is not responsible for the use and contents of those other sites (their accuracy, up-to-date nature and availability) and shall not be liable towards the User for any harm which the User may incur in connection with visiting and using those other sites.
The Operator hereby excludes his liability for damages to the maximum extent possible under the mandatory provisions of applicable laws of the Czech Republic and limits his liability for damages to CZK 0 in cases where this is not possible.
Intellectual property
Unless otherwise stated in the these GTC and/or on the Website, the contents of the Website (including text, photographs, images and design implementation) are the exclusive property of the Operator or the Operator has the right to use it (by law or by contract). The Operator does not grant the User any licence or other intellectual property rights in or to the Website and its components, except for the right to view and use of the Website in accordance with the these GTC.
Furthermore, the User shall not, without the Operator’s prior written consent, reproduce, copy, modify, tamper with the source code of, transfer or assign any rights in or to the Website or its components. Otherwise, the User shall be liable for any damage incurred by the Operator and/or third parties as a result of such unauthorised conduct.
The Operator’s consent is revocable at any time, without any entitlement to compensation, at the Operator’s sole discretion.
Final arrangements
These GTC, as well as the relationship between the Operator and the User shall be governed by the laws of the Czech Republic, regardless of the law of the country from which the User visited or used the Website. Any disputes arising in connection with the use of the Website shall be resolved by a court of locally and materially competent jurisdiction in the Czech Republic, regardless of the law of the country from which the User visited or used the Website.
The Operator is entitled to change these GTC at any time, without any prior notice addressed to the Users.
These GTC are written in Czech and English and in case of discrepancies between the language versions, the Czech version prevails.
